CONCEPT NOTE

Innocence of a child is a gift to cherish and partake and to not play foul” should be the motto of the World. Innocence lost is a crime upon humanity. Wisdom today, is to understand the indisputably ever growing relevance of the status of child in development ladder of economy at regional and at international level. The reality check shows how the disparity in development indicators amongst children actually impact the nature of inclusive growth and development. From the ancient “welfare” principle reflected in the dominant ideology of family, the family had absolute authority, control and rights over children to the modern day transition which has led to the principle of “rights” also known as entitlements and therefore imply goals and obligations on the part of community and the state to pioneer the cause of rights. Social Justice, nondiscrimination, equity and empowerment are the core values which define and determine the realm of Child rights in the present era. Significant work has been done to spread awareness and promote the cause of Child Rights at regional and international level when one third of the world's population is that of children. The law, policy and practice in this regard has undergone major change and keeps getting updated with plethora of framework discussed, deliberated and put to implementation at domestic and international level. UN through its specialized agencies and organs has placed impetus on the importance of child rights. UN promotes the rights and wellbeing of every child across the globe. Together with their partners, UN works in 190 countries and territories to translate that commitment into practical action, focusing special effort on reaching the most vulnerable and excluded children, to the benefit of all children, everywhere. The above mission is supported by States, business men, philanthropists, industries and individuals to sustain and expand health, nutrition, water and sanitation, education and child protection programmes for all children. The perspective of the rights on child is contained in United Nations Convention on the Rights of the Child, 1989 which is landmark legislation in the realm of human rights.

The idea of “Justice” to the child has garnered attention of all sections of society alike and warrants more efforts and attention keeping in minds the growing concerns of environmental challenges, disputes and conflicts within and between States and the shortage of financial resources and political will. The news of refugee children, orphaned by war and victimised by the perpetrators of crime who engage them in life threatening activities by training them to fight wars to abusing them as slaves and indulge in child trafficking reaches us every day, but what we are determined to do today will determine the future of generations to come.

Child Abuse is emphasized as a principal inhibitor in child development. The Constitutions of India also guarantees certain child rights covering basic issues, like 'health', 'education' and protection from 'hazardous employment' and 'exploitation'. However, despite the existence of many legal provisions, the vulnerability of children in different dimensions cannot be undermined. The role of Judiciary through its decisions to curb down upon Child Labour and celebrate the health and educational rights of children in India and abroad has not only helped the cause but enhanced and sealed the effort making process in this regard. With the advent of electronics and technology, the matter of online crimes against children is on the rise and despite of the fact that both Information Technology Act, 2000 (amended in 2008) and Protection of Children from Sexual Offences Act, 2012 (POCSO Act) have addressed several online crimes against children and POCSO Act has also provided mechanisms to report crimes against children, including online crimes, the threats have increased not only in quantum but also means. Apart from this, the National Commission for Protection of Rights of Children (NCPCR) and National Commission for Women (NCW) have also provided several online platforms for reporting of online child victimization cases. This shows the efforts in the direction to attain justice for children. The thrust has to initiate a shift in making the parents, educational institutions and students themselves aware of the issue and the policy measures. Parents and teachers are considered to be the most trusted caregivers for children. Only a combined pledge and effort on part of the State, Media, international bodies, regional bodies, police and law and enforcement machinery, non-governmental organizations, UN and individuals which shall make this world a better place for children and reinstate faith in humanity alone.
