This month marks the anniversary of the landmark Kesavananda Bharati v. State of Kerala AIR 1973 SC 1461 (March 24, 1973) case, which established the "Basic Structure Doctrine". This doctrine is pivotal in safeguarding the core principles of our Constitution, limiting the amending power of Parliament, and ensuring the protection of fundamental rights.
The case arose when Kesavananda Bharati, a religious leader, challenged the Kerala government's land reforms that affected the management of his religious institution's property. The Supreme Court, in a historic verdict, ruled that while Parliament has the power to amend the Constitution, it cannot alter its "basic structure," thereby safeguarding the fundamental rights and core principles enshrined in the Constitution
