State can't reply upon confessional statements recorded before police: SC

In an appeal filed by the accused/ petitioner seeking bail, the Hon'ble Supreme Court was shocked to note that the respondent state, in its counter affidavit, has relied upon the confessional statements recorded before the police.

“In the counter affidavit filed by the respondent State of West Bengal, shockingly, the State has relied up so called confessional statements of the petitioner accused recorded by the police. To put it mildly, we are shocked to note that the State is relying upon confessional statements recorded before the police.,” Hon'ble Justices Abhay S. Oka and Ujjal Bhuyan stated.
